Temporary storage “is the temporary storage of non-Union goods under customs supervision in the period between their presentation and their placement under a customs procedure or their re-exportation.” This is not a customs procedure, but rather the period preceding it. Imported non-Union goods must be declared for temporary storage immediately after presentation (Art. 145 UCC).

Non-Union goods are automatically placed in temporary storage from the moment they are presented for clearance (Article 144 of the Union Customs Code (UCC)). This legal status serves to ensure customs supervision until the goods are placed under a customs procedure or re-exported.

The goods may not be altered in any way while in temporary storage. Only necessary maintenance measures, such as dusting, cooling, ventilation, etc., are permitted. Further treatment such as packaging or processing is not permitted (Art. 147(2) UCC).

However, with the consent of the customs office, the party concerned may examine the goods or take samples and specimens, e.g. to enable classification in the customs tariff or to determine the customs value. The request for examination of the goods can generally be made verbally, but a written request is required for the taking of samples and specimens. Form 0312 must be used for this purpose.

During temporary storage, the goods are subject to considerable restrictions. Put simply, only necessary maintenance measures may be carried out. Transport from one custodian to another is possible, but must be reported to the customs office. Storage can be carried out at the customs office, by a third party, or by the recipient. Storage in a bonded warehouse may also be required.

Termination of temporary storage: within 90 days, the goods must be placed under a customs procedure or re-exported (Art. 149 UCC).
